General Terms of Use and Privacy Policy

The following terms are used in these General Terms of Use and Privacy Policy:
User – the user of the software package (hereinafter: “User”)
Školska knjiga d. d. – the publisher and holder of all rights to the software package (hereinafter: “Publisher”)

1. This agreement sets out the terms of use for the software package protected by law as a work of authorship / intellectual property consisting of a computer program, instructions for use, and the Kirurgija application.

2. The User shall obtain the software package free of charge when purchasing the Surgery university textbook.

3. By using the software package, the User accepts the terms and conditions laid out in these General Terms of Use.

4. The Publisher hereby grants the User a non-transferable right to use the software package in the period of two years from the day of its activation, which refers to the digital edition of Surgery, exclusively for personal needs, in accordance with these General Terms of Use. The User is prohibited from using the software package for commercial purposes or engaging in any malicious use, whether commercial or free of charge.

5. Intellectual property rights and copyright on all parts of the software package referred to in point 1 of these General Terms of Use are owned by the Publisher and other persons listed in the Impressum of particular works and/or with whom the Publisher has entered into an agreement.

6. The User may not make the Kirurgija application available to others. The User may not change or allow others to change the software package, either in its entirety or its parts, or create other works by using particular works of authorship or their parts contained therein, or use the software package in any way that is contrary to these General Terms of Use and the options offered by the software package itself.

7. The user may not reproduce, duplicate, share, or use commercially or maliciously the software package in its entirety or its parts in any way or allow others to do the same.

8. The user shall use the software package exclusively at own risk. The Publisher shall not bear responsibility for any loss or damage incurred by the use of the software package. Furthermore, the Publisher shall not bear responsibility for any inability to use the software package, lack of access to the Publisher’s website or security issues (hacking, computer viruses, etc.) or any issues related to the User’s computer or any other device. The Publisher shall not bear responsibility to any damage incurred on the User’s device while using the software package, except in the event of gross negligence on the part of the Publisher, in which case the sole responsibility shall lie with the Publisher.

9. The software package and the surgery.skolskaknjiga.hr website will make every effort to keep the information contained therein accurate and complete, without bearing responsibility for its truthfulness and completeness or for the content of external links.

10. The software package and the surgery.skolskaknjiga.hr website shall not bear responsibility for any damage that may be inflicted on the user’s computer if files are downloaded from portals or websites which the user might access by following the links provided.

11. The software package shall become available to the User in its entirety after launching the installation process, which shall be recorded on the Publisher’s server.

12. The Publisher hereby guarantees that the User will be able to use the software package on the Windows 10 operating system.

13. By activating a single code for the use of the software package, the User may use the software package on a maximum of two devices: one desktop computer and one mobile device.

14. A single user may not create multiple user accounts with the same e-mail address.

15. By accepting these General Terms of Use, the User is made aware that, if they replace a device by another of the same type, the system will enable the use of the software package on the new device within a period of no longer than 72 hours, which is required for the registration of the new device on the Publisher’s system.

16. All content and photographs published as part of the software package or on www.surgery.skolskaknjiga.hr remain the sole property of the Publisher. Any redistribution or reproduction of material downloaded from this website must include attribution and a link to the Publisher’s website (e.g., downloaded from www.surgery.skolskaknjiga.hr).

17. The software package and the surgery.skolskaknjiga.hr website reserve the right to change at any time the content of the surgery.skolskaknjiga.hr website and its terms of use without prior notice.

18. The data entered in the registration form shall not be made available to the public and it shall be stored on surgery.skolskaknjiga.hr solely to provide users with a better service based on the information given.

19. The software solution and surgery.skolskaknjiga.hr shall respect the privacy of its users and visitors, and all data collected from the registration forms shall be used exclusively for user authentication, analysis, statistics, and the functioning of the software solution and the website. The surgery.skolskaknjiga.hr website shall not share any user or visitor data to third parties.

20. Any privacy-related changes shall be posted on this page in a timely manner or communicated to users via other appropriate channels.

21. The User shall bear responsibility for any activity appearing under their username, consciously assuming responsibility for their actions.

22. The Publisher shall provide assistance to the User by e-mail (info@skolskaknjiga.hr) regarding any issues related to the use of the software package.

23. The user may exercise the rights arising from these General Terms of Use by proving their status with their username and password on the Publisher’s website.

24. If it should be discovered that the User is acting in breach of these General Terms of Use, the User’s right to use the software package and the agreement between the Publisher and the User shall be automatically terminated, and the User shall compensate the Publisher for any damage thereby incurred.

25. By clicking on “I accept the terms of use”, the User declares their agreement with these General Terms of Use and that they have been made aware of the material and criminal liability arising from behavior contrary to these General Terms of Use.

26. In the event of a dispute arising between the parties to this agreement that cannot be settled amicably, the relevant court is the Court in Zagreb and the law applied shall be the law of the Republic of Croatia.
