SOFTWARE USE AGREEMENT
between the user of the software package (hereinafter: “User”)
and Školska knjiga d. d., Masarykova 28, Zagreb, Croatia, as the holder of all rights to the software package (hereinafter: “Publisher”)
1. This agreement sets out the terms of use for the software package protected by law as a work of authorship / intellectual property consisting of a computer program, instructions for use, and the Kirurgija application.
2. By using the software package, the User becomes a party to this agreement and accepts its terms and conditions.
3. The Publisher hereby grants the User a non-transferable right to use the software package exclusively for personal needs, in accordance with this agreement. The User is prohibited from using the software package for commercial purposes.
4. Intellectual property rights and copyright on all parts of the software package referred to in point 1 of this agreement are owned by the Publisher and the persons listed in the Impressum of particular works and/or with whom the Publisher has entered into an agreement.
5. The User may not make the Kirurgija application available to others. The User may not change or allow others to change the software package, either in its entirety or its parts, or create other works by using particular works of authorship or their parts contained therein, or use the software package in any way that is contrary to this agreement and the options offered by the software package itself.
6. The user may not reproduce, duplicate, share, or commercially use the software package in its entirety or its parts in any way or allow others to do the same.
7. The user shall use the software package exclusively at own risk. The Publisher shall not be responsible for any loss or damage incurred by the use or inability to use the software package due to lack of access to the Publisher’s website or due to security issues (hacking, computer viruses, etc.) or any issues related to the User’s device.
8. The software package shall become available to the User in its entirety after launching the installation process, which is recorded on the Publisher’s server.
9. The Publisher hereby guarantees that the User will be able to use the software package on the Windows 10 operating system.
10. The Publisher shall provide assistance to the User by e-mail info@skolskaknjiga.hr regarding any issues related to the use of the software package.
11. The user may exercise the rights arising from this agreement by proving their status with their username and password on the Publisher’s website.
12. If it should be discovered that the User is acting in breach of the terms and conditions of this agreement, this agreement shall be automatically terminated, and the User shall compensate the Publisher for any damage thereby incurred.
13. By clicking on “I accept the terms of use”, the User confirms that they agree with the terms and conditions of this agreement and that they have been made aware of the material and criminal liability arising from behavior contrary to this agreement.
14. In the event of a dispute arising between the parties to this agreement that cannot be settled amicably, the relevant court is the Court in Zagreb and the law applied shall be the law of the Republic of Croatia.
